## Expert advice on JBSP Mortgages, Joint Borrower Sole Proprietor

Speak to a Mortgage Lane adviser about your options.

## In short

A JBSP mortgage, joint borrower sole proprietor, is a residential mortgage on which two or more people are borrowers, jointly and severally liable for the whole loan, while only one of them owns the property.

## What is a JBSP mortgage?

**A JBSP mortgage, joint borrower sole proprietor, is a residential mortgage on which two or more people are borrowers, jointly and severally liable for the whole loan, while only one of them owns the property.** The supporting borrower's income is included in the lender's affordability assessment, which increases what the buyer can borrow, but the supporting borrower holds no legal or beneficial interest in the property: they are not on the title at HM Land Registry, they do not own a share, and they acquire no stamp duty or capital gains position of their own. Lenders commonly allow up to four borrowers, usually restrict supporting borrowers to close family, set the maximum term by reference to the borrowers' ages, and require the supporting borrower to take independent legal advice before completion. JBSP mortgages are regulated residential lending under the Financial Conduct Authority's [MCOB](https://www.handbook.fca.org.uk/handbook/MCOB/) rules.

The structure's tax logic is its reason for existing: because the supporting borrower owns no share, a parent who already owns a home does not trigger the additional-dwelling Stamp Duty Land Tax surcharge on the purchase ([gov.uk SDLT](https://www.gov.uk/stamp-duty-land-tax)), and the buyer keeps first-time buyer relief and first-time buyer scheme eligibility where they qualify. Putting the parent on the title as a co-owner would lose all three.

## JBSP mortgage rates

**How the pricing is built:** JBSP mortgages are priced as standard residential products at the loan-to-value of the purchase, from the lenders that offer the structure. Some as a labelled JBSP range, some as an option on their main range. The structure itself does not carry a premium; the term, the loan-to-value and the borrowers' credit profiles set the price as on any residential mortgage. Comparison runs across the JBSP-capable lenders on rate, fee, term and the lender's rules on borrower age and family relationship.

**Short on income but with a parent who can help?** Get in touch with both incomes, the deposit and the property. We run the combined affordability, the term the lender will allow and the stamp duty position before any application.

## JBSP mortgage criteria

**JBSP criteria are set lender by lender: the structure and its stamp duty treatment are the same everywhere, but the number of borrowers, the family relationships accepted, the term rule and the maximum loan-to-value differ.** The table shows the common position and, where it says so, what we see on the cases we arrange. Our experience is not a lender's published rule: the lender's criteria, the valuation and every borrower's affordability decide the actual terms.

## JBSP mortgage criteria

*JBSP mortgage criteria*

| Criterion | Value |
| --- | --- |
| Ownership | Sole proprietor. The buyer alone on the title; supporting borrowers hold no legal or beneficial interest |
| Borrowers | Up to four on the mortgage in our experience, all jointly and severally liable for the whole loan; some lenders allow fewer |
| Relationship | Supporting borrowers usually restricted to close family, such as parents, grandparents, siblings and children; rules on other relationships vary by lender |
| Affordability | All borrowers' incomes assessed, with all borrowers' commitments, including the supporting borrower's own mortgage. Deducted |
| Term | Set by reference to the borrowers' ages. Some lenders use the oldest borrower; in our experience some will base the term on the younger borrower, depending on how the older borrower's income is used. Maximum age at the end of the term varies by lender |
| Independent legal advice | Required for the supporting borrower before completion, evidenced to the lender |
| Deposit | From the buyer's savings or a gift; the supporting borrower may gift the deposit as well as add income |
| Stamp duty | No additional-dwelling surcharge for a supporting borrower who owns another home, because they acquire no interest; buyer's first-time buyer relief preserved where eligible |
| Maximum LTV | In our experience up to 95% with some lenders, with most JBSP lending up to 90%; the lender's criteria and the valuation decide |
| Purpose | Purchase; remortgage; Right to Buy purchases; removal of a supporting borrower by remortgage |
| Buy to let | Available with some lenders in our experience, for example where a supporting borrower helps meet a lender's minimum income requirement; the rent must still pass the lender's rental calculation |
| Exit | Supporting borrower removed by remortgage or transfer of the mortgage into the buyer's sole name once the buyer's income carries the loan |

## Types of JBSP arrangement, and how each works

**JBSP is one structure applied to several situations, and the situation decides who is on the mortgage, for how long, and what happens at exit.**

### First-time buyer with a parent as supporting borrower

The core case: a buyer whose income supports a smaller loan than the home costs, and a parent whose income closes the gap. The parent joins the mortgage, takes independent legal advice, and is removed by remortgage when the buyer's income has grown: the exit planned at the outset because the parent's age often sets the term. The buyer keeps first-time buyer stamp duty relief and scheme eligibility. The wider family-assistance options are compared in the [first-time buyer mortgage guide](https://mortgagelane.com/guides/first-time-buyer-mortgage-guide).

**Get in touch** with both incomes and the target purchase price.

### JBSP mortgage with a partner

A couple buying together can add a parent as a third borrower. Both partners on the title, the parent on the mortgage only, where the couple's combined income still falls short. Lenders that allow up to four borrowers accommodate two owners and two supporting borrowers; the owners take the property as joint tenants or tenants in common, and the supporting borrower's position is unchanged by the number of owners.

**Get in touch** with all three incomes for a couple-plus-parent JBSP.

### JBSP Right to Buy

A council tenant buying under Right to Buy can add family income through JBSP while keeping sole ownership, which the scheme requires. The tenant is the sole proprietor, the family member is a supporting borrower, and the discount serves as the deposit. The Right to Buy criteria, discount rules and the confirmed reforms are on our [Right to Buy mortgages](https://mortgagelane.com/mortgages/right-to-buy-mortgages) page.

**Get in touch** with the Right to Buy offer notice and the family member's income.

### The reverse case. Child supporting a parent

JBSP runs both ways: an adult child can join a parent's mortgage as a supporting borrower. Helping a parent buy or remortgage where the parent's income or age limits the loan, without acquiring an interest in the parent's home. Lenders assess the child's own commitments and, where the child owns a home, the stamp duty position is unaffected because no interest passes.

**Get in touch** for a child-supporting-parent JBSP.

### JBSP for a remortgage or to remove a supporting borrower

An existing JBSP mortgage is remortgaged like any other; the moment the buyer's own income supports the loan, the supporting borrower is removed by [remortgage into the buyer's sole name](https://mortgagelane.com/mortgages/single-person-mortgages). No transfer of equity is needed because no equity was ever transferred. Lenders reassess affordability on the buyer alone at that point. Our page on [life insurance when declined](https://mortgagelane.com/insurance/life-insurance-when-declined) covers what to do if an insurer refuses life cover.

**Get in touch** when your income has grown enough to carry the loan alone.

### The JBSP deposit

The deposit comes from the buyer, from a gift, or from the supporting borrower. A parent can add income to the mortgage and [gift the deposit](https://mortgagelane.com/mortgages/gifted-deposit-mortgages) at the same time, subject to a gift letter confirming no repayment and no interest in the property. A gifted deposit from a supporting borrower does not change their non-owner status, and the inheritance tax position of the gift is the donor's, under the seven-year rule.

**Get in touch** to structure the deposit alongside the income support.

## JBSP mortgage lenders

**JBSP is offered by a defined set of lenders, high-street banks and building societies with a labelled JBSP option, and specialist lenders, each with its own rules on the number of borrowers, the family relationship, how the term is set against the borrowers' ages, and whether the supporting borrower's own mortgage is deducted in full.** The lenders differ most on age: some set the term by the oldest borrower, which can compress the term severely where a parent is in their sixties; others assess on the younger borrower where the supporting borrower is to be removed within a set period. That single rule decides many cases, and it is the reason the lender is chosen before the affordability is run. Dated searches for "JBSP lenders 2021" or "2022" reflect how quickly the panel has changed; the current panel is what a broker works from.

Where a lender sets the term by the oldest borrower, a parent aged 60 facing a maximum age of 75 caps the term at 15 years, and the higher payment that follows can undo the extra income.

## How a JBSP mortgage is arranged

1. **Incomes, commitments and ages.** Every borrower's income and commitments, including the supporting borrower's own mortgage, and every borrower's age against the lender's term rules; the stamp duty position confirmed.
2. **Lender match and agreement in principle.** The case placed with a JBSP-capable lender whose age and relationship rules fit; a decision in principle on the combined affordability.
3. **Full application, valuation and independent legal advice.** The lender's application on all borrowers; the valuation; the supporting borrower's independent legal advice, certified to the lender.
4. **Offer, legal work and completion.** The mortgage offer to all borrowers; the conveyancer registers the buyer alone as proprietor; completion, with the exit plan documented.

## The JBSP arithmetic. Income, term and stamp duty

**Three numbers change when a supporting borrower joins the mortgage: the income the lender counts, the term the lender allows, and the stamp duty the purchase attracts.**

### Step 1. Income

An illustrative first-time buyer earning £30,000, with a parent earning £40,000 joining as supporting borrower:

*Illustrative arithmetic; 4.5 times income is an illustrative multiple, not a product term. The lender's affordability assessment, including the supporting borrower's own mortgage and every borrower's loan and credit card commitments, decides the actual figure. Not an offer of finance.*

The parent's income more than doubles the loan on the multiple alone; in practice the parent's own mortgage payments, and any loan or credit card payments of either borrower, are deducted from the combined affordability, which is why the supporting borrower's commitments are gathered before the calculation, not after.

### Step 2. Term

If the lender sets the term by the oldest borrower and the parent is 60 with a maximum age of 75 at the end of the term, the term is capped at 15 years, and the monthly payment on £315,000 over 15 years is far higher than over 30, which can undo the income benefit. A lender that assesses the term on the younger borrower where the supporting borrower will be removed within a set period restores the long term. This is the rule that decides JBSP cases, and it differs lender by lender.

### Step 3. Stamp duty

The surcharge and the lost relief on a £300,000 purchase can together amount to tens of thousands of pounds: the reason joint ownership with a parent is rarely the right structure now that JBSP exists.

### Step 4. Liability and exit

The supporting borrower is jointly and severally liable for the whole loan: if the buyer stops paying, the lender can pursue the supporting borrower for the full amount, and the mortgage appears on the supporting borrower's credit file and in their own affordability for any borrowing of their own. Independent legal advice exists to make that clear. The exit, remortgage into the buyer's sole name once their income carries the loan, is planned at the outset, and no transfer of equity is needed because the supporting borrower never held any.

### What decides the case

The incomes and ages are fixed; the buyer controls the lender (the age rule differs most), the deposit source, the number of borrowers and the exit timing. Run income, term and stamp duty together before choosing the structure.

## Frequently asked questions about jbsp mortgages, joint borrower sole proprietor

**Q: What is a JBSP mortgage?**

faq-id: what-is-a-jbsp-mortgage

A JBSP mortgage, joint borrower sole proprietor, is a residential mortgage on which two or more people are borrowers, jointly liable for the whole loan, while only one of them owns the property. The supporting borrower's income counts in affordability, but they hold no legal or beneficial interest in the home and are not on the title.

**Q: How does a JBSP mortgage work?**

faq-id: how-does-a-jbsp-mortgage-work

A JBSP mortgage works by adding a family member to the mortgage as a joint borrower without adding them to the title, so the lender assesses all borrowers' incomes and commitments together while registering the buyer alone as owner. The supporting borrower takes independent legal advice and is removed later by remortgage once the buyer's income carries the loan.

**Q: Does a JBSP mortgage affect stamp duty?**

faq-id: does-a-jbsp-mortgage-affect-stamp-duty

A JBSP mortgage does not trigger the additional-dwelling Stamp Duty Land Tax surcharge for a supporting borrower who already owns a home, because the supporting borrower acquires no interest in the property. The buyer keeps first-time buyer relief where they qualify, which a co-owning parent who had owned before would remove.

**Q: Who can be a supporting borrower on a JBSP mortgage?**

faq-id: who-can-be-a-supporting-borrower-on-a-jbsp-mortgage

A supporting borrower on a JBSP mortgage is usually a close family member, such as a parent, grandparent, sibling or adult child, because most lenders restrict the structure to family; rules on other relationships vary by lender. In our experience lenders allow up to four borrowers in total, including the owner.

**Q: Can I get a JBSP mortgage with my partner?**

faq-id: can-i-get-a-jbsp-mortgage-with-my-partner

You can get a JBSP mortgage with a partner by having both partners on the title and a parent or relative on the mortgage as a supporting borrower, where the couple's combined income falls short. Lenders that allow up to four borrowers accommodate two owners and two supporting borrowers.

**Q: Does the supporting borrower own part of the property?**

faq-id: does-the-supporting-borrower-own-part-of-the-property

The supporting borrower on a JBSP mortgage does not own any part of the property: they are not registered at HM Land Registry, hold no beneficial interest, and have no claim on the equity or sale proceeds. Their position is liability for the loan, not ownership of the home.

**Q: Is the supporting borrower liable for the mortgage?**

faq-id: is-the-supporting-borrower-liable-for-the-mortgage

The supporting borrower on a JBSP mortgage is jointly and severally liable for the whole loan, so the lender can pursue them for the full amount if the owner stops paying. The mortgage appears on their credit file and counts in their own affordability, which is why lenders require them to take independent legal advice.

**Q: How is the mortgage term set on a JBSP mortgage?**

faq-id: how-is-the-mortgage-term-set-on-a-jbsp-mortgage

The mortgage term on a JBSP mortgage is commonly set by the oldest borrower's age at the end of the term, which can compress the term where a parent is older, while some lenders assess the term on the younger borrower where the supporting borrower will be removed within a set period. The rule differs by lender and decides cases.

**Q: Which lenders offer JBSP mortgages?**

faq-id: which-lenders-offer-jbsp-mortgages

JBSP mortgages are offered by a defined set of high-street banks, building societies and specialist lenders, some as a labelled JBSP range and some as an option on their main products. Each sets its own rules on the number of borrowers, family relationship, age and term, and treatment of the supporting borrower's own mortgage.

**Q: Are JBSP mortgage rates higher?**

faq-id: are-jbsp-mortgage-rates-higher

JBSP mortgage rates are not higher because of the structure: JBSP loans are priced as standard residential products at the loan-to-value of the purchase, from the lenders that offer the option. The term, loan-to-value and the borrowers' credit profiles set the rate, as on any residential mortgage.

**Q: Can the supporting borrower be removed from a JBSP mortgage later?**

faq-id: can-the-supporting-borrower-be-removed-from-a-jbsp-mortgage-later

A supporting borrower can be removed from a JBSP mortgage by remortgaging into the owner's sole name once the owner's income supports the loan on its own, with the lender reassessing affordability on the owner alone. No transfer of equity is needed, because the supporting borrower never held any interest in the property.

**Q: Can a JBSP mortgage be used for Right to Buy?**

faq-id: can-a-jbsp-mortgage-be-used-for-right-to-buy

A JBSP mortgage can be used for Right to Buy, allowing a council tenant to add a family member's income to the mortgage while remaining the sole owner, which the scheme requires. The Right to Buy discount serves as the deposit, and the family member holds no interest in the property.

**Q: Can the supporting borrower also gift the deposit?**

faq-id: can-the-supporting-borrower-also-gift-the-deposit

A supporting borrower can gift the deposit as well as add income to a JBSP mortgage, subject to a gift letter confirming no repayment and no interest in the property. The gift does not change the supporting borrower's non-owner status, and its inheritance tax position is the donor's under the seven-year rule.

**Q: What is a JBSP mortgage calculator?**

faq-id: what-is-a-jbsp-mortgage-calculator

A JBSP mortgage calculator estimates the maximum loan on the owner's income alone and on the combined income of all borrowers, after deducting each borrower's commitments including a supporting borrower's own mortgage, and shows the term allowed under the lender's age rules. Lender affordability decides the actual figure.

**Q: Does a JBSP mortgage affect the supporting borrower's own mortgage?**

faq-id: does-a-jbsp-mortgage-affect-the-supporting-borrower-s-own-mortgage

A JBSP mortgage affects the supporting borrower's own borrowing because the JBSP loan appears on their credit file and is counted as a commitment in any future affordability assessment of their own, including a remortgage of their home. Their own mortgage is likewise deducted in the JBSP affordability assessment.

**Q: Can I get a JBSP buy to let mortgage?**

faq-id: can-i-get-a-jbsp-buy-to-let-mortgage

Some lenders offer JBSP on buy to let, and in our experience it can be used where a supporting borrower's income helps the applicant meet a lender's minimum income requirement. The rent still has to pass the lender's rental calculation, and fewer lenders offer JBSP on buy to let than on residential purchases, so the lender is chosen before applying. A gifted deposit or a limited company structure are the other common routes for family support on a buy to let purchase.

**Q: What happens to a JBSP mortgage if the supporting borrower dies?**

faq-id: what-happens-to-a-jbsp-mortgage-if-the-supporting-borrower-dies

If a supporting borrower on a JBSP mortgage dies, the mortgage continues with the remaining borrowers and the lender reassesses affordability on the owner, who may need to remortgage in their sole name or add another supporting borrower. Life cover on the supporting borrower is commonly arranged for this reason.

**Q: What is the difference between a JBSP mortgage and a guarantor mortgage?**

faq-id: what-is-the-difference-between-a-jbsp-mortgage-and-a-guarantor-mortgage

A JBSP mortgage puts the supporting borrower on the loan as a full joint borrower whose income is assessed, while a guarantor mortgage keeps the guarantor off the loan and makes them liable only if the borrower defaults, often with security over the guarantor's home or savings. Lenders have largely moved from guarantor to JBSP structures.

**Q: Does a JBSP mortgage need independent legal advice?**

faq-id: does-a-jbsp-mortgage-need-independent-legal-advice

A JBSP mortgage needs independent legal advice for the supporting borrower, from a solicitor separate from the buyer's conveyancer, confirming they understand they are liable for the whole loan without owning the property. The lender requires the solicitor's certificate before completion.

**Q: How long does a JBSP mortgage take to arrange?**

faq-id: how-long-does-a-jbsp-mortgage-take-to-arrange

A JBSP mortgage takes as long as a standard purchase mortgage, typically several weeks from application to offer, with the supporting borrower's independent legal advice and the lender's assessment of all borrowers' incomes and commitments the additional items. Choosing a lender whose age rules fit is the usual accelerator.
