## At a glance

A [divorce settlement bridging](https://mortgagelane.com/definitions#def-divorce-settlement-bridging) loan is short-term finance used to meet a financial settlement on time — usually to buy out a former partner's share of the home, or to pay a lump sum — when the [remortgage](https://mortgagelane.com/definitions#def-remortgage) in one name, or the sale of a property, that will eventually repay it cannot complete fast enough. Because the security is usually the family home that the borrower lives in, the bridge is normally regulated by the [Financial Conduct Authority](https://mortgagelane.com/definitions#def-financial-conduct-authority), and the lender must be satisfied there is a credible way to repay it. The hardest part is not the bridge but the exit: a sole-name remortgage must be affordable on one income, so it is tested before the bridge is taken.

## How Mortgage Lane can help

Mortgage Lane arranges bridging and the follow-on mortgage for separating couples and individuals — buy-outs, lump sums, transfers of [equity](https://mortgagelane.com/definitions#def-equity), and purchases before a matrimonial home is sold — working with family solicitors to the timetable in the order.

## What is a divorce settlement bridging loan?

A divorce settlement bridging loan is a short-term loan secured on property — usually the family home, sometimes another property — used to pay a former spouse or civil partner what a settlement or court order requires, repaid by a remortgage or sale. Where the borrower or a related person lives in the property, it is a regulated [bridging loan](https://mortgagelane.com/definitions#def-bridging-loan) under the FCA's [MCOB](https://www.handbook.fca.org.uk/handbook/MCOB/) rules. Unregulated bridging applies where the security is investment property.

## Rates

**How the pricing is built:** regulated bridging on a home is priced monthly by loan-to-value; lower loan-to-values and a clear exit attract better terms. Compare total cost to the expected exit, set against the cost of missing the settlement deadline.

## Criteria

*Criteria*

| Criterion | Value |
| --- | --- |
| Security | Family home or other property |
| Regulation | Regulated if borrower or related person lives in the property |
| Court order | Sealed consent order or agreed settlement usually required |
| Exit | Sole-name remortgage, sale, or other assets |
| Exit affordability | Sole income tested for remortgage exits |
| Existing mortgage | Redeemed by the bridge or retained with a second charge |
| Term | Matched to remortgage or sale timescale |
| Former partner | Consent and removal from title handled by solicitors |

*Criteria vary by lender and must be checked for your application.*

## Buying out a former partner

The bridge repays the [joint mortgage](https://mortgagelane.com/definitions#def-joint-mortgage) and pays the former partner's share, with the property transferred into one name. The sole-name mortgage that follows must cover the bridge [redemption figure](https://mortgagelane.com/definitions#def-redemption-statement) on one income — testing that exit too late risks a repayment shortfall.

## Other settlement uses

- **Lump sum orders** — paying a lump sum before an asset is sold.
- **Buying a new home** before the matrimonial home sells, so the parent with children can move.
- **[Second charge](https://mortgagelane.com/definitions#def-charge-priority)** — where the existing joint mortgage is kept, sometimes with lender consent to a [transfer of equity](https://mortgagelane.com/definitions#def-transfer-of-equity).

## Court orders and timing

In England and Wales, under no-fault divorce since April 2022, the final order replaced the decree absolute; the financial order is usually made as a [consent order](https://mortgagelane.com/definitions#def-consent-order). Lenders generally want the sealed order or a settlement agreed through solicitors before funds are released. Timing the bridge to the order — not before — avoids paying interest while legal steps are outstanding.

## The exit

- **Sole-name remortgage** — tested on one income, including maintenance received where lenders accept it.
- **Sale** — of the home or another asset, with realistic price and timescale.
- **Other funds** — pension sharing does not usually release cash for repayment.

See [remortgaging after a bridging loan](https://mortgagelane.com/short-term-finance/remortgage-after-bridging-loan).

## How it works

01

### Step 1

Settlement and order reviewed with your solicitor.

02

### Step 2

Sole-name remortgage or sale exit tested.

03

### Step 3

Bridge sized to the redemption figure and settlement.

04

### Step 4

Regulated bridging application and valuation.

05

### Step 5

Completion on the order's timetable; remortgage or sale repays the bridge.

## Buying out a £150,000 share: the arithmetic

**An illustrative £500,000 family home with a £200,000 joint mortgage; one partner buys out the other's half of the £300,000 equity.**

### Illustrative figures

*Buying out a £150,000 share: the arithmetic*

| Item | Amount |
| --- | --- |
| Redeem joint mortgage | £200,000 |
| Pay former partner | £150,000 |
| Fees and interest (illustrative lump) | £20,000 |
| Bridge gross loan | £370,000 (74% LTV) |
| Income needed for a £370,000 sole-name remortgage at 4.5× | About £82,200 |

*Illustrative; fees, interest and [income multiple](https://mortgagelane.com/definitions#def-loan-to-income) are illustrative assumptions. Not an offer of finance or legal advice.*

If the remaining partner earns £55,000, the remortgage exit supports about £247,500 — far short. The bridge would then need a sale exit, a smaller buy-out, or additional income or a joint borrower to make the remortgage work.

### What decides the case

Test the sole-name remortgage before agreeing the settlement figure, and use a bridge only where the exit can repay it in full.

## Regulation and the property used as security

Regulation depends on the borrower, the security, its intended use and any applicable exemption. A loan to an individual or trustees secured on land used or intended for use as a dwelling may fall within the [regulated mortgage](https://mortgagelane.com/definitions#def-regulated-mortgage) rules; business lending has additional exclusions. Ask the adviser to confirm the classification before proceeding.

## Divorce Settlement Bridging Loans FAQs

**Q: What is a divorce settlement bridging loan?**

faq-id: short-term-finance-divorce-settlement-bridging-loans-what-is-a-divorce-settlement-bridging-loan

A divorce settlement bridging loan is short-term finance secured on property, used to meet a financial settlement on time — such as buying out a former partner's share of the home or paying a lump sum — and repaid later by a remortgage or sale.

**Q: When is a bridging loan used in a divorce?**

faq-id: short-term-finance-divorce-settlement-bridging-loans-when-is-a-bridging-loan-used-in-a-divorce

A bridging loan is used when a settlement must be paid before a sole-name remortgage or property sale can complete, for example to buy out a former partner by a court deadline or to fund a new home before the family home sells.

**Q: Can I use a bridging loan to buy out my ex-partner?**

faq-id: short-term-finance-divorce-settlement-bridging-loans-can-i-use-a-bridging-loan-to-buy-out-my-ex-partner

You can use a bridging loan to buy out a former partner, repaying the joint mortgage and paying their share, with the property transferred into your name. The bridge is then repaid by a sole-name remortgage that must be affordable on your income.

**Q: Is a divorce bridging loan regulated?**

faq-id: short-term-finance-divorce-settlement-bridging-loans-is-a-divorce-bridging-loan-regulated

A divorce bridging loan secured on a home that you or a related person live in is regulated by the Financial Conduct Authority (FCA), and the lender must be satisfied that you have a credible repayment strategy. Bridging on investment property is usually unregulated.

**Q: How much can I borrow on a divorce bridging loan?**

faq-id: short-term-finance-divorce-settlement-bridging-loans-how-much-can-i-borrow-on-a-divorce-bridging-loan

The amount depends on the property's value, the lender's maximum loan-to-value and the exit. With a remortgage exit, the bridge should not exceed what a sole-name mortgage can repay on your income, including fees and interest.

**Q: Do I need a court order for a divorce bridging loan?**

faq-id: short-term-finance-divorce-settlement-bridging-loans-do-i-need-a-court-order-for-a-divorce-bridging-loan

Lenders usually want a sealed consent order or a settlement agreed through solicitors before releasing funds, so the payment and the transfer of the property are legally documented. Some will issue terms in advance to fit the timetable.

**Q: What is a consent order?**

faq-id: short-term-finance-divorce-settlement-bridging-loans-what-is-a-consent-order

A consent order is a court order recording the financial settlement agreed between divorcing spouses or separating civil partners, making it legally binding. Lenders and conveyancers rely on it to confirm the payment and the property transfer.

**Q: What replaced the decree absolute?**

faq-id: short-term-finance-divorce-settlement-bridging-loans-what-replaced-the-decree-absolute

In England and Wales, under the no-fault divorce rules in force from 6 April 2022, the final order replaced the decree absolute, and the conditional order replaced the decree nisi. Financial orders are usually made alongside, often as consent orders.

**Q: Can a bridge fund a lump sum order?**

faq-id: short-term-finance-divorce-settlement-bridging-loans-can-a-bridge-fund-a-lump-sum-order

A bridging loan can fund a lump sum ordered in a financial settlement, secured on a property that will be sold or remortgaged to repay it. The lender needs evidence of the exit and the timetable.

**Q: Can I buy a new home before the family home sells?**

faq-id: short-term-finance-divorce-settlement-bridging-loans-can-i-buy-a-new-home-before-the-family-home-sells

A bridging loan can fund a new home before the family home sells, for example for the parent with children, secured on the new property and sometimes the family home. The family home's sale repays the bridge.

**Q: What if the sole-name remortgage is not affordable?**

faq-id: short-term-finance-divorce-settlement-bridging-loans-what-if-the-sole-name-remortgage-is-not-affordable

If a sole-name remortgage cannot repay the bridge, options include a smaller buy-out, adding a joint borrower who does not own the home, using maintenance income where lenders accept it, or a sale exit. These are tested before taking the bridge.

**Q: Can maintenance income help a sole-name mortgage?**

faq-id: short-term-finance-divorce-settlement-bridging-loans-can-maintenance-income-help-a-sole-name-mortgage

Some lenders count spousal or child maintenance as income for a mortgage where it is set by a court order or formal agreement and has been received regularly. Lender policies vary on how much they count.

**Q: Can I keep the existing joint mortgage?**

faq-id: short-term-finance-divorce-settlement-bridging-loans-can-i-keep-the-existing-joint-mortgage

Where the existing lender agrees to a transfer of equity into one name, the existing mortgage can sometimes continue, with a second-charge bridge funding the buy-out. The lender assesses the remaining borrower's [affordability](https://mortgagelane.com/definitions#def-affordability).

**Q: Can a pension sharing order repay a bridge?**

faq-id: short-term-finance-divorce-settlement-bridging-loans-can-a-pension-sharing-order-repay-a-bridge

A pension sharing order usually transfers pension rights rather than cash, so it rarely provides funds to repay a bridge. Pension commencement lump sums can be taken only within pension rules, so lenders seldom accept them as an exit.

**Q: How long does a divorce bridging loan take?**

faq-id: short-term-finance-divorce-settlement-bridging-loans-how-long-does-a-divorce-bridging-loan-take

A divorce bridging loan can complete in a few weeks once the order or settlement is agreed, the valuation is done and the solicitors have dealt with the title and the former partner's removal. Starting early avoids missing the deadline.

**Q: Who pays for the bridging loan in a divorce?**

faq-id: short-term-finance-divorce-settlement-bridging-loans-who-pays-for-the-bridging-loan-in-a-divorce

Usually the partner keeping the property takes the bridge and pays its costs, though the settlement may reflect them. Your family solicitor advises on how the costs are dealt with in the settlement.

**Q: Can I get a divorce bridging loan with bad credit?**

faq-id: short-term-finance-divorce-settlement-bridging-loans-can-i-get-a-divorce-bridging-loan-with-bad-credit

Bridging lenders focus on the security and exit, so [adverse credit](https://mortgagelane.com/definitions#def-adverse-credit) is considered case by case. The sole-name remortgage exit must also accept the credit history, which is checked before the bridge is arranged.

**Q: What happens if I cannot repay the divorce bridging loan?**

faq-id: short-term-finance-divorce-settlement-bridging-loans-what-happens-if-i-cannot-repay-the-divorce-bridging-loan

If the exit fails, the options are an extension, [re-bridging](https://mortgagelane.com/definitions#def-re-bridging) or selling the property. Because a divorce bridge is usually secured on your home, the lender can ultimately repossess, which is why the exit is tested first.

**Q: Is a second charge better than a bridging loan in a divorce?**

faq-id: short-term-finance-divorce-settlement-bridging-loans-is-a-second-charge-better-than-a-bridging-loan-in-a-divorce

A second charge loan can fund a buy-out over a longer term while keeping the existing mortgage, which suits borrowers who can afford monthly payments. A bridge can suit a purchase when a remortgage or sale will follow within months.

**Q: Do I need independent legal advice?**

faq-id: short-term-finance-divorce-settlement-bridging-loans-do-i-need-independent-legal-advice

You need your own family solicitor for the settlement and a conveyancer for the property transfer and bridge. A former partner being removed from the title also takes their own legal advice.
