Frequently asked questions
Are residential property mortgages regulated?
Yes. A mortgage on your own home is normally a regulated mortgage contract, and in the UK residential mortgages are regulated by the Financial Conduct Authority (FCA). The FCA sets rules for lenders and brokers that cover how mortgages are marketed and promoted, the advice customers receive, the affordability assessments lenders carry out and the way complaints are handled.
This regulation is there so that products suit the customer's needs and borrowers are treated fairly throughout. If you have a problem with your mortgage provider, you have the right to complain and seek redress. Mortgage Lane is an FCA authorised firm and adheres to these rules in the advice it gives.
Can a regulated bridge affect my residential mortgage?
A regulated bridge on your home may be reported to credit reference agencies and assessed by a residential lender as existing borrowing, unless the new mortgage is repaying it. Disclosing it upfront avoids surprises at underwriting.
Is income protection regulated?
Yes. Income protection is a pure protection insurance contract, and firms that advise on or arrange it carry out insurance distribution, regulated by the Financial Conduct Authority under its Insurance: Conduct of Business sourcebook, known as ICOBS (FCA Handbook: ICOBS 1.1). The Prudential Regulation Authority also supervises insurers. When you apply you have a legal duty to take reasonable care not to misrepresent your health or circumstances, and a complaint the firm does not resolve can go to the Financial Ombudsman Service.
Is family income benefit regulated?
Yes. Family income benefit is a pure protection contract, long-term insurance that pays only on death or incapacity and has no cash-in value (FCA Handbook: pure protection contract). Advising on and arranging it is insurance distribution, regulated by the Financial Conduct Authority under its Insurance: Conduct of Business sourcebook (ICOBS), not under the mortgage rules. The adviser must identify your demands and needs before a policy is taken out. If a complaint about the policy or a claim is not resolved, you can take it to the Financial Ombudsman Service free of charge.
What mortgage can I afford on 50k?
On a £50,000 income, the mortgage you can afford depends on debts, deposit, credit history, dependants, mortgage term and lender criteria. A rough income multiple may indicate possible borrowing, but it is not guaranteed. Existing loans, childcare costs or poor credit can reduce affordability significantly.
